ARTICLE I.- PREAMBLE.
The REPUBLICAN PARTY OF CUBA is hereby constituted as an independent political organization.
IDEOLOGY
Convinced that a multiparty system with free elections in the pursuit of governmental power—based not on the will of the majority but on the supremacy of the law, without detriment to the rights of minorities and governing for all—is essential, we advocate for a secular State with independent Executive, Legislative, and Judicial branches. We support a presidential system of government, as this form of governance has proven to be the most ethical within Western civilization, to which we belong, and constitutes part of our fundamental principles.
We defend the free market and a limited State that acts as an arbiter of the society it represents and to which it is accountable. We uphold respect for freedom, rights, and the individual development of all persons, regardless of race, religion, political ideas, sex, or disability. We promote a humanistic society in which its most vulnerable sectors are not allowed to live in misery and are protected by the State to ensure their opportunity for a dignified and happy life.
The REPUBLICAN PARTY OF CUBA firmly believes in a Republic whose fundamental basis is the rule of law and shall work tirelessly to translate these principles into social consciousness, with the aim of fostering national pride, equal justice, international advocacy for human rights, social decency, individual civic responsibility within an active political society, and a mindset of peace with freedom. These values shall result in a prosperous and modern nation, integrated into today’s globalized world without losing its independence or authentic roots.
OBJECTIVES
The permanent objective of the REPUBLICAN PARTY OF CUBA is to place leaders of the Party in the greatest possible number of political and administrative positions throughout the country, to carry out its political, economic, and social projects.
Section I.- Headquarters
The principal headquarters of the REPUBLICAN PARTY OF CUBA shall be located within the national territory and shall be designated by the National Executive Board (NEB). Said headquarters may be relocated for strategic reasons by decision of the Political Committee.
ARTICLE II.- MEMBERS
Section I.- Admission
Any person of sound mind who is willing to contribute time and talent in service of the Cuban nation and the REPUBLICAN PARTY OF CUBA may become a member. Membership shall be voluntary.
Section II.- Rights.
Members shall have the right to:
a).- Hold any position within the REPUBLICAN PARTY OF CUBA, provided their membership dues are current.
b).- Propose or be proposed as candidates to organs of power, provided their membership dues are current.
c).- Participate in meetings corresponding to their organizational level.
d).- Submit proposals, inquiries, and complaints regarding any violation, nonconformity, or disagreement, and demand a private or public response, as appropriate, based on the petitioner’s request and the interests of the organization.
e).- Discuss, debate, and vote in deliberations at the levels in which they participate.
f).- Appeal sanctions imposed upon them to higher instances.
g).- Withdraw voluntarily from the REPUBLICAN PARTY OF CUBA upon prior resignation.
Section III.- Duties. Members shall have the duty to:
a).- Comply with these Regulations.
b).- Contribute to the development and growth of the REPUBLICAN PARTY OF CUBA.
c).- Abide by resolutions and agreements adopted by their organizational level or higher instances.
d).- Return all documents and material resources of the REPUBLICAN PARTY OF CUBA in their possession upon leaving the organization or being relieved of any function.
e).- Refrain from issuing statements, providing information, or generating news on behalf of the REPUBLICAN PARTY OF CUBA without complying with the provisions established in the article governing Public Relations.
f).- Refrain from any form of factionalism, intrigue, or negligence against the organization or any of its members.
ARTICLE III.- STRUCTURE OF THE REPUBLICAN PARTY OF CUBA
Section I.- Hierarchical Structure
(The organizational structure of the REPUBLICAN PARTY OF CUBA shall be composed of the following levels):
a).- National Convention.
b).- National Executive Board (NEB).
c).- Provincial Executive Board (PEB).
d).- Municipal Executive Board (MEB).
e).- Delegations.
Section II.- Composition
a).- National Convention. The National Convention shall be composed of all leadership levels of the REPUBLICAN PARTY OF CUBA, in accordance with the structure established in these Regulations.
b).- National Executive Board (NEB). The National Executive Board shall include a Political Committee composed of three (3) members, in the following order:
• President.
• Executive Director.
• Deputy Executive Director.
• One Director per Province.
• One Director for the Special Municipality of Isla de la Juventud.
• National Treasurer.
• National Spokesperson.
• Secretary to the President and Executive Director.
• Director of the National Electoral Commission.
• Director of the National Ethics Commission.
• Five (5) Directors without specifically assigned functions, plus any additional Directors deemed necessary for the proper functioning of the Party.
c).- Provincial Executive Board (PEB). The Provincial Executive Board shall be composed of:
• Provincial Director.
• Deputy Provincial Director.
• One Director per municipality.
• Provincial Treasurer.
• Provincial Spokesperson.
• Member of the National Electoral Commission.
• Member of the National Ethics Commission.
• External Logistics Delegate.
d).- Municipal Executive Board (MEB). The Municipal Executive Board shall be composed of:
• Municipal Director.
• Deputy Municipal Director.
• Municipal Delegates.
• Deputy Municipal Delegates.
• Municipal Treasurer.
• Municipal Spokesperson.
• External Logistics Delegate.
e).- Delegation. Each Delegation shall be composed of:
• Delegate.
• Deputy Delegate.
• Treasurer.
• Delegation Spokesperson.
More than one Delegation may exist within a municipality. All Delegations shall be subordinate to and coordinated by the Municipal Director.
ARTICLE IV.- POWERS
Section I.- National Convention.
All authority of the REPUBLICAN PARTY OF CUBA resides in the National Convention, which shall delegate the execution of its agreements to the National Executive Board (NEB). The NEB shall utilize all levels of the Party structure to implement such agreements and may establish additional working commissions when deemed necessary.
Section II.- Political Committee.
The Political Committee shall issue directives that cannot await the convening of the National Convention and shall design strategies to ensure the effective functioning of the REPUBLICAN PARTY OF CUBA. Directives issued by the Political Committee shall carry the same authority as those adopted by the National Convention.
Section III.- National Executive Board (NEB).
a).- The National Executive Board shall be convened by the Executive Director. During such meetings, prior agreements shall be reviewed; reports from Provincial Directors shall be analyzed; financial statements at all levels shall be reviewed by the National Treasurer; and the political impact of the Party’s positions on society, as well as matters of national and international interest, shall be discussed.
b).- Decisions shall be adopted by simple majority vote. Absences shall not be justified. In exceptional cases, Provincial Directors may delegate a Municipal Director to represent them; in the Special Municipality of Isla de la Juventud, a Delegate shall be designated. Members residing abroad may delegate their vote to a director participating by telephone, with the Executive Director assuming responsibility for such votes under current national conditions.
c).- At the first meeting, internal procedural rules shall be established to ensure efficiency and effectiveness. The date of the next meeting shall be set at each session. Membership dues shall also be established at the initial meeting.
Section IV.- Provincial Executive Board (PEB).
a).- The Provincial Executive Board shall be convened by the Provincial Director. Meetings shall review prior agreements, analyze reports from Municipal Directors, review provincial finances through the Provincial Treasurer, and evaluate political impact and relevant national or international issues.
b).- Decisions shall be adopted by simple majority vote. Absences shall not be justified. In exceptional cases, Municipal Directors may designate a Delegate to represent them.
c).- At the first meeting, internal procedural rules shall be established, and the date of the next meeting shall be set.
Section V.- Municipal Executive Board (MEB).
a).- The Municipal Executive Board shall be convened by the Municipal Director and shall review prior agreements, analyze reports from Delegates, review municipal finances, and discuss political impact and matters of interest.
b).- Decisions shall be adopted by simple majority vote. Absences shall not be justified. In exceptional cases, the Deputy Delegate may represent the Delegate.
c).- Internal procedural rules shall be established at the first meeting, and the date of the next meeting shall be set.
Section VI.- Delegation.
a).- The Delegation constitutes the fundamental base of the REPUBLICAN PARTY OF CUBA and is essential to its success and influence on society.
b).- Delegation meetings shall be convened by the Delegate at the request of the Municipal Director. Financial reports shall be presented, and community needs shall be identified and elevated to higher levels for resolution.
c).- The Party shall function as a fraternal organization that channels the aspirations of the people, which can only be achieved through effective Delegations.
d).- Party leaders at all levels shall remain closely linked to and attentive to the Delegations.
ARTICLE V.- LEADERSHIP.
Section I.- Functions, Rights, and Duties of the President.
a).- The President of the REPUBLICAN PARTY OF CUBA is the highest authority within the organization and shall be accountable to the National Convention for the results of all activities, directives, and guidelines.
b).- The President shall define the ideological line and political strategy of the REPUBLICAN PARTY OF CUBA.
c).- The President shall oversee and be accountable for the Party’s finances, with the support of the Executive Director and the National Treasurer.
d).- The President shall convene the National Convention on a date agreed upon by the National Executive Board.
e).- The President shall convene meetings of the Political Committee and may convene meetings of the National Executive Board when deemed necessary.
f).- The President shall instruct the Executive Director to ensure compliance with the agreements adopted by the National Convention and the National Executive Board at all levels.
g).- The President shall sign documents that legally bind the REPUBLICAN PARTY OF CUBA, as well as internal documents that impose binding compliance within the organization.
h).- The President shall approve, jointly with the Executive Director, national and international documents and statements that legally bind the REPUBLICAN PARTY OF CUBA.
i).- In cases of emergency, the President may temporarily assume the powers of the National Executive Board for the duration of the emergency.
j).- The President shall appoint their Secretary and, under current national conditions, the Secretary of the Executive Director.
k).- The provision referring to the Director of Ethics and Elections is hereby declared null and void, as amended.
l).- The President may create commissions at their discretion to carry out specific tasks, without requiring the election of their members.
m).- Under current national conditions, the President may establish operational groups without informing the National Executive Board when the nature of the task requires absolute discretion.
n).- The President of the REPUBLICAN PARTY OF CUBA must renounce any aspiration to future presidential candidacies in a democratic Cuba or to any other elected public office. This requirement is mandatory to hold the office of President of the Party. Should the President wish to pursue such candidacies after serving as Party President, they must resign from the position at least two regular presidential terms prior to declaring their intention. This provision is immutable and shall not be subject to amendment.
Section II.- Functions, Rights, and Duties of the Executive Director.
a).- The Executive Director is the highest executive authority responsible for the implementation of all projects of the REPUBLICAN PARTY OF CUBA.
b).- The Executive Director shall organize and direct all activities through all levels of the Party structure to achieve the objectives established by the National Convention and to ensure compliance with agreements adopted by the National Executive Board.
c).- The Executive Director shall convene meetings of the National Executive Board and any other meetings deemed necessary, whether collectively or individually, in the interest of the Party.
d).- The Executive Director shall activate the Electoral Commission, the Ethics Commission, and any other commissions created, and shall issue instructions prior to the execution of their functions.
e).- The Executive Director shall oversee the Party’s finances and assets, with the support of the Deputy Executive Director, Treasurers at all levels, Directors at all levels, and any members of whom information is required.
f).- The Executive Director is directly subordinate to the President and to these Regulations.
g).- The Executive Director shall submit reports upon request by the President.
h).- The Executive Director should maintain open channels of communication to attend to Party members who request interviews or guidance.
i).- The Executive Director shall temporarily replace the President should the latter be unable to perform their duties, in which case elections shall be organized as expeditiously as possible.
j).- The Executive Director shall enforce sanctions based on reports and recommendations issued by the Ethics Commission. Such sanctions may be appealed only through a request by a member of the National Executive Board acting on behalf of the sanctioned party and shall require approval by vote of the National Executive Board.
k).- The Executive Director shall approve, jointly with the President, national and international documents and statements that legally bind the REPUBLICAN PARTY OF CUBA, with the support of the National Spokesperson.
Section III.- Functions, Rights, and Duties of the Deputy Executive Director.
a).- The Deputy Executive Director shall rank immediately below the Executive Director in authority and shall assist in the execution of their duties.
b).- The Deputy Executive Director shall act as administrator and coordinator of the Party’s finances and assets, with the support of the National Treasurer and Treasurers at other levels.
c).- The Deputy Executive Director shall order extraordinary audits at any level, review audit reports prior to their presentation to the National Convention when requested and supervise ordinary audits together with the National Treasurer.
d).- The Deputy Executive Director shall submit reports upon request by the President.
e).- The Deputy Executive Director is subordinate to the President, the Executive Director, and these Regulations.
f).- The Deputy Executive Director shall maintain open channels of communication with Party members.
g).- The Deputy Executive Director shall temporarily replace the Executive Director should the latter be unable to perform their duties, in which case elections shall be organized as expeditiously as possible.
Section IV.- Functions, Rights, and Duties of the Provincial Director.
a).- The Provincial Director is the highest authority of the REPUBLICAN PARTY OF CUBA within the Province and serves as its representative on the National Executive Board (NEB).
b).- The Provincial Director is the executive authority responsible for the implementation of all projects of the REPUBLICAN PARTY OF CUBA within the Province. The Provincial Director shall organize and direct all activities by utilizing all levels of the provincial structure to achieve the results established in the agreements adopted at provincial meetings.
c).- The Provincial Director shall convene provincial meetings and any other meetings deemed appropriate, whether collectively or individually with directors and members of the province, whenever such meetings serve the interests of the REPUBLICAN PARTY OF CUBA.
d).- The Provincial Director shall oversee and audit the finances and assets of the REPUBLICAN PARTY OF CUBA within the Province, with the support of the Provincial Treasurer, Municipal Treasurers, and Delegation Treasurers, and shall submit reports to the National Executive Board (NEB).
e).- The Provincial Director shall ensure that all officials and members within the province, from leadership to rank-and-file members, are familiar with Article I of these Regulations, including the ideology and objectives of the REPUBLICAN PARTY OF CUBA.
f).- The Provincial Director shall be subordinate to the President, the Executive Director, the Deputy Executive Director, and to these Regulations.
g).- The Provincial Director shall facilitate and support members of the National Executive Board (NEB) in carrying out tasks and assignments arising from the Board itself or from the Political Committee within the Province.
Section V.- Functions, Rights, and Duties of the Municipal Director.
a).- The Municipal Director is the highest authority of the REPUBLICAN PARTY OF CUBA within the Municipality and serves as its representative before the province.
b).- The Municipal Director is the executive authority responsible for the implementation of all projects of the REPUBLICAN PARTY OF CUBA within the Municipality. The Municipal Director shall organize and direct all activities by utilizing all levels of the municipal structure to achieve the results established in the agreements adopted at municipal meetings.
c).- The Municipal Director shall convene municipal meetings and any other meetings deemed appropriate, whether collectively or individually with directors and members of the Municipality, whenever such meetings serve the interests of the REPUBLICAN PARTY OF CUBA.
d).- The Municipal Director shall oversee and audit the finances and assets of the REPUBLICAN PARTY OF CUBA within the Municipality, with the support of the Municipal Treasurer and Delegation Treasurers and shall submit reports to the province.
e).- The Municipal Director shall ensure that all officials and members within the Municipality, from leadership to rank-and-file members, are familiar with Article I of these Regulations, including the ideology and objectives of the REPUBLICAN PARTY OF CUBA.
f).- The Municipal Director shall be directly subordinate to the Provincial Director, to the members of the National Executive Board (NEB), and to these Regulations.
g).- The Municipal Director shall facilitate and support members of the National Executive Board (NEB), the Political Committee, and the Provincial leadership in carrying out tasks and assignments arising from such bodies within the Municipality.
Section VI.- Functions, Rights, and Duties of the Delegate.
a).- The Delegate is the most important grassroots official of the REPUBLICAN PARTY OF CUBA and represents the Party within the community.
b).- The Delegate(s) shall support the Municipal Director in convening meetings and shall ensure attendance and security under the current conditions of the country, relying on the support of all members of the Delegation leadership.
c).- The Delegate shall oversee and audit the finances and assets of the REPUBLICAN PARTY OF CUBA assigned for the work of the Delegation, with the support of the Delegation Treasurer, and shall submit reports to the Municipal Director.
d).- The Delegate is the direct representative and public face of the REPUBLICAN PARTY OF CUBA before the community. The Delegate’s talent, organizational capacity, and leadership are what make it possible to convey the message of prosperity and hope that this Party proposes for the Cuban nation.
e).- The Delegate shall ensure that all officials and members of the Delegation, from leadership to rank-and-file members, are familiar with these Regulations, with particular emphasis on Article I, including the ideological principles and objectives of the REPUBLICAN PARTY OF CUBA.
f).- The Delegate shall remain accessible to the members of the Delegation and shall channel and address their concerns, seeking higher-level assistance whenever a prompt resolution is not within the Delegate’s authority.
g).- The Delegate constitutes the first link in the great fraternity that is the REPUBLICAN PARTY OF CUBA in relation to its membership.
h).- The Delegate shall be directly subordinate to the Municipal Director and to these Regulations.
Section VII.- Functions, Rights, and Duties of the National Treasurer Director.
a).- The National Treasurer Director shall maintain permanent control over all financial information, assets, and the location thereof belonging to the REPUBLICAN PARTY OF CUBA.
b).- The National Treasurer Director shall submit reports on the financial status of the organization at the National Convention and at meetings of the National Executive Board (NEB).
c).- The National Treasurer Director shall provide reports regarding finances or assets upon request by members of the Political Committee.
d).- The National Treasurer Director shall provide information to members of the REPUBLICAN PARTY OF CUBA regarding the status of the organization’s finances and assets, regardless of the reason for such request. For this purpose, the National Treasurer Director may rely on one or more Treasurers as necessary to ensure that such information is provided in a clear and accurate manner.
e).- The National Treasurer Director shall be directly subordinate to the Deputy Executive Director and shall assist the latter in their role as administrator and coordinator of the finances and assets of the REPUBLICAN PARTY OF CUBA.
f).- The National Treasurer Director shall be a member of the National Executive Board (NEB) and, for the fulfillment of their duties, shall rely on Treasurers at all levels of the REPUBLICAN PARTY OF CUBA.
g).- The National Treasurer Director shall supervise all sources created by the REPUBLICAN PARTY OF CUBA at all levels for the generation of financial resources.
h).- The National Treasurer Director shall work with Provincial Directors, Municipal Directors, and Delegates, in compliance with Article V, Section IV, subsection (d); Section V, subsection (d); and Section VI, subsection (c) of these Regulations.
Section VIII.- Functions, Rights, and Duties of the Provincial, Municipal, and Delegation Treasurer Directors.
a).- Treasurers shall observe and comply with the provisions set forth in Article V, Section I, subsection (c); Section II, subsection (e); Section III, subsections (b) and (c); Section IV, subsection (d); Section V, subsection (d); Section VI, subsection (c); and Section VII, subsections (a), (d), (f), and (g) of these Regulations.
b).- Transparency throughout the organization—particularly among the men and women who hold the office of Treasurer and are responsible for the administration of the organization’s finances and assets—is of paramount importance.
Section IX.- Functions, Rights, and Duties of the National Spokesperson Director.
a).- The National Spokesperson Director shall be responsible for all documents published in the name of the REPUBLICAN PARTY OF CUBA and, under the current conditions of the country, shall supervise all news and information released at all organizational levels.
b).- The National Spokesperson Director shall remain fully informed of the projects and strategies of the REPUBLICAN PARTY OF CUBA, to ensure that information disseminated both internally and publicly is properly focused and aligned with the Party’s objectives.
c).- The National Spokesperson Director shall maintain continuous and effective communication with Spokespersons of the REPUBLICAN PARTY OF CUBA at all levels.
d).- The National Spokesperson Director shall be accessible without limitation of hours to be consulted by Spokespersons and directors of the REPUBLICAN PARTY OF CUBA, to ensure that information and news of the Party circulate promptly and under appropriate supervision.
e).- The National Spokesperson Director shall supervise and monitor the campaigns and publicity of the REPUBLICAN PARTY OF CUBA, relying on the support of Spokespersons at their respective levels.
f).- The National Spokesperson Director shall ensure that these Regulations are available in printed form in every Delegation of the REPUBLICAN PARTY OF CUBA throughout the country, relying on Spokespersons at all levels for such purpose.
g).- The National Spokesperson Director shall ensure that all Spokespersons are fully aware of the responsibility they assume when covering or disseminating news, that such information is duly authorized and signed by the officials corresponding to the appropriate level, and that it does not involve or implicate other sectors of the organization not directly related thereto.
h).- The National Spokesperson Director shall be directly subordinate to the members of the Political Committee and to these Regulations.
i).- The National Spokesperson Director shall supervise the official digital platform of the REPUBLICAN PARTY OF CUBA, www.partidorepublicanodecuba.org, ensuring its proper updating and shall maintain close communication with its Webmaster.
Section X.- Functions, Rights, and Duties of the Director of International Relations.
a).- The Director of International Relations of the REPUBLICAN PARTY OF CUBA shall be responsible for executing the international policy of the Party and for promoting and ensuring actions abroad. Such policy should be established and directed by the Political Committee of the organization.
b).- The Director of International Relations shall be a member of the National Executive Board (NEB) and shall be consulted and entitled to vote on all decisions approved by that body, as well as to submit initiatives for consideration.
c).- The Director of International Relations shall have the rights and duties of a Party member as set forth in these Regulations, to which they are subject.
d).- The Director of International Relations has the right to participate, in a personal capacity, in any event to which they are invited, to engage in social and community activism, and to make statements on various matters, provided that such actions and statements are not contrary to the values promoted by the Party as a political institution.
e).- The Director of International Relations shall be directly subordinate to the Political Committee, with which they shall establish their closest working relationship.
f).- The Director of International Relations shall rely on the Overseas Branches in advancing their agenda, as well as on the National Spokesperson.
g).- Any statement made in the name of the REPUBLICAN PARTY OF CUBA by the Director of International Relations must be approved by the Political Committee, and the Director shall ensure direct communication with the President of the REPUBLICAN PARTY OF CUBA, as well as alignment with the strategies and objectives of their participation in any events.
h).- The holder of this position may be proposed by a member of the Political Committee and must be approved by the National Executive Board (NEB). The Director of International Relations may be freely removed by the Political Committee and shall be a member of the National Executive Board (NEB). This position entails a high level of responsibility and public representation of the REPUBLICAN PARTY OF CUBA.
ARTICLE VI.- ELECTIONS.
Section I.- Electoral Commission.
a).- The Electoral Commission is hereby established to ensure the legality and validity of all elections conducted within the REPUBLICAN PARTY OF CUBA, as well as the founding of Delegations.
b).- Composition:
1 .- One National Director, who shall be a member of the National Executive Board (NEB) and may or may not hold other functions within the REPUBLICAN PARTY OF CUBA.
2 .- One member in each Provincial Executive Board (PEB), regardless of the function they perform within the REPUBLICAN PARTY OF CUBA, designated by the National Director of Elections to supervise any election to be held within the province or the founding of a new Delegation.
c).- Functions:
1 .- The Commission shall be present to supervise and confer legality upon elections or the founding of Delegations wherever such events take place.
2 .- The Commission may be accompanied by the Provincial Director, the Municipal Director, or other members it deems appropriate to invite. The presence of the corresponding Municipal Director and Provincial Director is mandatory for the elections in question, notwithstanding that the Commission is the authority empowered to validate the legality of elections.
3 .- The Commission shall draft a report addressed to the President, the Executive Director, and the National Director of Elections. If the National Director of Elections is present, said report shall be prepared by that official for final approval and confirmation.
d).- A date must be established for the approval of such events, which shall be agreed upon by the Provincial Director, the Municipal Director, and the member of the Commission or the National Director. All parties should endeavor to be flexible and reasonable in determining such date. The members of the Electoral Commission shall have the final authority in reaching said agreement, without abuse of authority. The event may be scheduled at any time or day, regardless of how irregular it may appear. Any individual who fails to attend shall be subject to sanctions imposed at the discretion of the Executive Director. Only force majeure circumstances—such as death, presentation of a police detention record, or hospitalization supported by official medical documentation—shall constitute valid justification. No other incident shall excuse absence.
e).- Information regarding these activities shall be scheduled at least fifteen (15) days in advance, shall be communicated to all parties involved, and may be requested by any instance through the Executive Director.
f).- Prior to the commencement of the event, the Commission shall properly identify itself with the nominees and voters participating therein. If valid objections arise, they shall be analyzed on site, and if not resolved, the elections may be suspended.
g).- Once elections are legally approved by the Commission, the results shall be final and non-appealable and shall be determined by simple majority vote. The Commission shall determine, based on the characteristics of the event, whether a sufficient quorum exists to proceed and may suspend the elections if so decided.
h).- Should problems arise during an election that the Commission member is unable to resolve, the elections should be suspended and rescheduled to be conducted in the presence of the National Director of Elections, who must be informed of every election held, considering the provisions of subsection (e).
i).- The National Director of Elections may be proposed by any member of the National Executive Board (NEB) and must be approved by a vote of NEB. Any active member of the REPUBLICAN PARTY OF CUBA—meaning with current membership dues paid—may be eligible for this position.
j).- The remaining members of the National Electoral Commission shall consist of one member in each Provincial Executive Board (PEB) and shall be designated by the Director of the National Electoral Commission in coordination with the Provincial Director.
k).- This Commission shall be directly subordinate to the President and the Executive Director.
Section II.- Elections.
a).- All offices of the REPUBLICAN PARTY OF CUBA shall be subject to election every five (5) years from the date of election and may be reelected indefinitely, provided that the individual’s physical or mental capacities do not conflict with the proper performance of their duties.
b).- Elections may be held in advance in cases of resignation or removal from office for any reason.
c).- Whenever elections are conducted, the presence of the Electoral Commission shall be mandatory. The Commission shall be activated in accordance with Article V, Section II, subsection (d), by the Executive Director.
d).- Requests for and the conduct of elections shall follow the procedures established in Article VI of these Regulations.
Section III.- Founding of Delegations and the Democratic Line of Advancement within the REPUBLICAN PARTY OF CUBA. (The founding of Delegations and the democratic line of advancement within the REPUBLICAN PARTY OF CUBA shall follow the procedure set forth below).
a).- For the founding of Delegations, the presence of the member of the National Electoral Commission assigned to the corresponding Provincial Executive Board (PEB) shall be required.
b).- The membership of existing Delegations shall elect the Municipal Director, who may be any active member—meaning a member whose membership dues are current. Such election shall, in turn, confer on the Provincial Executive Board.
c).- Municipal Directors shall elect the Provincial Director, whose election shall, in turn, confer membership on the National Executive Board (NEB).
d).- Provincial Directors shall elect the President, the Executive Director, and the Deputy Executive Director.
e).- Other Directors who are members of the National Executive Board (NEB) shall be proposed by members of NEB and shall require approval by NEB. Subsection (a) of Section II of Article VI shall not apply to these officials, who may be replaced for other reasons. Such decisions shall be made by the Political Committee of the REPUBLICAN PARTY OF CUBA.
ARTICLE VII.- ETHICS COMMISSION.
Section I.-
a).- The Ethics Commission is hereby established to resolve internal conflicts within the REPUBLICAN PARTY OF CUBA. Matters addressed by this Commission shall not be made public.
b).- Composition:
1 .- One National Director, who may or may not hold other functions within the REPUBLICAN PARTY OF CUBA.
2 .- The National Director of Ethics may be proposed by any member of the National Executive Board (NEB) and must be approved by a vote of NEB. Any active member of the REPUBLICAN PARTY OF CUBA—meaning with current membership dues paid—may be eligible for this position.
3 .- One member in each Provincial Executive Board (PEB), regardless of the function they perform within the REPUBLICAN PARTY OF CUBA, designated by the National Director of Ethics.
c).- Functions:
1 .- The Commission shall be activated by order of the Executive Director, at the request of any member, or upon knowledge of irregularities in the relationships among members of the REPUBLICAN PARTY OF CUBA or in their conduct, regardless of the functions they hold.
2 .- Upon arrival at the location where the conflict exists, the Commission shall properly identify itself with those involved. Only the parties directly responsible shall participate, and, at the Commission’s discretion, third parties may be consulted.
3 .- The Commission shall meet at any location where a conflict arises that the parties involved are unable to resolve on their own. The Commission shall hear the parties, analyze the matter, and issue recommendations with the intent of resolving the conflict. If a resolution is achieved, the Commission shall record in writing the commitments reached and shall submit a report to the President, the Executive Director, and the National Director of the Ethics Commission. If the conflict is not resolved, the Commission shall prepare a report with recommendations addressed to the President, the Executive Director, and the National Director of Ethics if the latter is not present. If the National Director of Ethics is present, that official shall prepare the report, so that the Executive Director may decide with the approval of the President.
d).- Designation of Commission Members:
1 .- The remaining members of the National Ethics Commission shall consist of one member in each Provincial Executive Board (PEB) and shall be designated by the Director of the National Ethics Commission in coordination with the Provincial Director.
2 .- This Commission shall be directly subordinate to the President and the Executive Director.
ARTICLE VIII.- EXTERNAL LOGISTICS DELEGATES.
Section I.-
a).- The Municipal Executive Boards (MEB) and Provincial Executive Boards (PEB), respectively, shall be responsible for the selection and approval of this important official.
b).- The External Logistics Delegate shall be a member of the respective Executive Boards and shall operate abroad within the Operational Group of Logistics Delegates, whose working committee is chaired by Mr. Ibrahim Bosch López, and, in his absence, by Ms. Magdelivia Hidalgo González.
c).- Logistics Delegates shall have one (1) vote within their respective Executive Boards and shall enjoy the same rights and obligations established in these Regulations.
d).- Once a Province has four (4) Municipalities with designated Logistics Delegates, it may proceed to establish a Provincial External Logistics Delegate, who shall coordinate efforts at the provincial level and shall also belong to the same Operational Group.
e).- Logistics Delegates shall operate under the guidelines and strategic orientation issued by the External Logistics Operational Group.
f).- An External Logistics Delegate may utilize their shipping and delivery channels, and the materials sent need not be destined for their own Municipality or Province but may instead be directed to support another geographical area, as determined by logistics leadership.
g).- Municipal and Provincial leadership bodies, upon receiving logistical materials, shall not utilize such materials without authorization and must report their receipt to receive instructions regarding their destination. This provision complements subsection (e).
h).- Logistical materials may arrive without prior notice to avoid alerting the political police; hence the provisions set forth in subsections (e) and (f). All such circumstances arise from the policing regime currently in place.
i).- Logistics Delegates shall be subordinate to their corresponding Executive Boards, to the External Logistics Operational Group, and to these Regulations.
ARTICLE IX.- OVERSEAS BRANCH.
The purpose of the existence of these Overseas Branches is to bring together Cuban citizens dispersed throughout the world who reside in any given area, in order to work in the struggle against the dictatorship by supporting the REPUBLICAN PARTY OF CUBA, and, in the future, to contribute to the prosperity and happiness of the nation through our organization.
Section I.- Functions, Rights, and Duties of the Branch Director.
a).- The Branch Director is the direct representative and public face of the REPUBLICAN PARTY OF CUBA before the local community in the referenced location. Their talent, organizational capacity, and leadership are what make it possible to convey the message of prosperity and hope that this Party proposes for the Cuban nation.
b).- The Branch Director shall convene Branch meetings and shall ensure attendance and security, relying on the support of all members of the Branch leadership.
c).- The Branch Director shall organize activities and undertake initiatives at their discretion to commemorate historical dates, carry out protest events against the dictatorship (under the current conditions of the country), fundraising activities, and other actions for logistical support and dissemination of the organization.
d).- The Branch shall contribute to supporting the REPUBLICAN PARTY OF CUBA within the Island by coordinating with the Party’s Political Committee and the corresponding Logistics Delegate.
e).- Branch members shall participate in events and actions directed by the national leadership of the organization. Such directives shall take priority over any previously scheduled activities of the Branch.
f).- Regardless of the country in which they are located, Overseas Branches are directly subordinate to the Political Committee of the REPUBLICAN PARTY OF CUBA and to these Regulations.
g).- Overseas Branches are not subordinate to but should work in close coordination with the Director of International Relations.
h).- The Branch Director shall oversee and audit the finances and assets of the REPUBLICAN PARTY OF CUBA, whether delivered or not for operational purposes, with the support of the Branch Treasurer, and shall submit reports to the National Deputy Executive Director and the National Treasurer.
Section II.- Composition. (The Overseas Branch shall be composed of)
• Branch Director
• Deputy Branch Director
• Treasurer
• Spokesperson
a).- Elections shall be conducted among the membership of the Branch and shall be mandatory every five (5) years. Elections may be held earlier for various reasons but may not be postponed. (See Article VI of these Regulations.)
b).- Treasurers shall observe and comply with the provisions set forth in Article V, Section I, subsection (c); Section II, subsection (e); and Section III, subsections (b) and (c) of these Regulations.
c).- Transparency throughout the organization—particularly among the men and women who hold the position of Treasurer and are responsible for the administration of the organization’s finances and assets—is of paramount importance.
d).- Spokespersons shall be governed by the provisions of Article V, Section IX of these Regulations.
e).- The Branch Director shall ensure that all officials and members, from leadership to rank-and-file members, are familiar with these Regulations, with particular emphasis on Article I, including the ideological principles and objectives of the REPUBLICAN PARTY OF CUBA.
f).- The Branch Director shall ensure that all organizational logos used for different events include, at the bottom of the banner or display, the name of the Branch responsible for the activity.
